Thank you for visiting and shopping at Four Nails (also referred to herein as “we”, “us”, “our”, “shopfournails.com”). These Terms of Service (“Terms”) govern your access to and use of our website shopfournails.com (the “Site”) and your purchase of products from us. By accessing or using the Site or placing an order you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Site or place an order.

1. Definitions

“Customer”, “you”, “your” means the person who accesses, browses or places an order via the Site.
“Order” means your purchase of one or more of our products via the Site.
“Products” means the press-on nails, nail accessories (files, clippers, top/base coats) and any other goods we offer for sale on the Site.
“Territory” means Canada and the United States of America.

2. Eligibility

By placing an Order you represent and warrant that:

You are at least the age of majority in your jurisdiction (or otherwise able to form a binding contract);
You are legally capable of entering into binding contracts;
You reside in the Territory and your purchase is permitted under applicable law.

3. Orders, Payments & Pricing

All Orders are subject to acceptance by us. We reserve the right to refuse or cancel any Order for any reason (e.g., product availability, pricing error, suspected fraud).
Prices listed on the Site are in Canadian dollars (CAD) unless otherwise indicated. You are responsible for any applicable taxes, duties, customs fees and shipping costs.
Payment must be made at the time of Order via the payment methods we accept.
We may revise prices at any time, but changes will not affect Orders already accepted.

4. Shipping, Delivery & Risk

Shipping terms (time, carrier, cost) are as described on the Site (see our Shipping + Returns page for full details).
Risk of loss and title for Products passes to you upon our delivery to the carrier or otherwise when you or your designated carrier takes possession of the goods.
Delivery times are estimates only. We do not guarantee delivery by a particular date. We are not liable for any delays.

5. Returns, Refunds & Cancelations

Our Returns/Refund policy is described in full on our Shipping + Returns page, which forms part of these Terms.
You may cancel your Order before it has been shipped; once shipped, cancellation may not be possible except in accordance with our Returns policy.
We may refuse a return or refund if it does not comply with our Returns policy (for example, if Products are used, damaged, or missing packaging).

6. Use of Website & Prohibited Activities

You agree not to use the Site for any unlawful or prohibited purpose. Without limitation, you must not:

Violate any applicable law or regulation in your use of the Site;
Upload or transmit any viruses, malware or harmful code;
Use the Site to infringe any person’s intellectual property rights or privacy rights;
Attempt to interfere with the Site’s operation or security (including hacking, scraping, denial of service attacks);
Use the Site to collect or harvest personal data of other users;
Use any robot, spider, automated device or manual process to monitor or copy the Site’s content without our prior written permission.

The trademarks “Four Nails”, “shopfournails.com” and other logos and brand elements are our registered or unregistered trademarks. You may not use them without our prior written consent.

8. Disclaimer of Warranties & Limitation of Liability

Disclaimer of Warranties:
The Site and Products are provided on an “as is” and “as available” basis. We make no warranties of any kind, express or implied, regarding the Site or Products (including merchantability, fitness for a particular purpose, non-infringement or course of performance).

Limitation of Liability:
To the fullest extent permitted by applicable law, in no event will Four Nails, its directors, officers, employees or affiliates be liable to you or any third party for any indirect, incidental, special, punitive or consequential damages arising out of or relating to your use of the Site or purchase of Products, even if we were advised of the possibility of such damages. Our total aggregate liability to you for any claim under these Terms shall not exceed the amount you paid for the Product(s) giving rise to the claim (if any). 9. Governing Law & Dispute Resolution
